1. INTRODUCTION
   
   
   1. This page contains the Terms and Conditions governing your access to and use of the SATS HK website (defined in paragraph 2 below) and the Services (defined in paragraph 2 below). Please read these Terms and Conditions carefully. Your access to and use of the SATS HK website indicates your acceptance of these Terms and Conditions. If you do not accept these Terms and Conditions, you may not use the SATS HK website and should leave immediately.
   
   
   2. We may revise these Terms and Conditions from time to time by updating this page without prior notice. Changes to these Terms and Conditions will be immediately binding on you. You should therefore read this page prior to any future access to and use of the SATS HK website. Your access to and use of the SATS HK website will indicate acceptance by you of the then-applicable Terms and Conditions.
   
   
   
2. DEFINITIONS

   For the purposes of these Terms and Conditions, the following definitions apply:
   
   "Content" includes all Text, Graphics, Design and Programming used on the SATS HK website.

   "Design" includes the "look" and "feel" of the SATS HK website and the colour combinations and the page layouts of the SATS HK website.

   "Graphics" includes all photographs, videos, logos, buttons and other graphical elements on the SATS HK website, with the exception of paid advertising contents (if any).

   "Programming" includes all software, and both client-side code (HTML, JavaScript, etc.) and server-side code (Active Server Pages, VBScript, databases, etc.), used in connection with the SATS HK website.

   "SATS HK website" and the "Site" refer to:-

   • the website (www.aiSATS HK.in and www.aiSATS HK.com) in its entirety including all its individual web pages, and

   • any other websites in their entirety including all their individual web pages, operated by SATS HK from time to time, now or in future.

   "Services" mean any services that SATS HK may provide on the SATS HK website from time to time.

   "Text" includes all text on every page of the SATS HK website, whether editorial, navigational or instructional.

   "User" and "you" refer to any individual, firm, corporation, organization or entity who accesses the SATS HK website or uses the Services.

   "we", "us" and "SATS HK" refer to NACIL (A) and NACIL (I) Singapore Airport Terminal Services Limited Joint Venture, and its subsidiaries and associated companies, or any of them.

   The headings in these Terms and Conditions are for ease of reference only and shall not be taken into account in the interpretation of any of these Terms and Conditions. Words importing the singular meaning shall where the context so admits include the plural meaning and vice versa. Words importing any one gender shall include all other genders as appropriate and words denoting natural persons shall include firms and corporations and all such words shall be construed interchangeably in that manner.

3. INTELLECTUAL PROPERTY RIGHTS
   
   
   1. All contents are the absolute property of SATS HK (subject only to paragraph 3b below), and are protected by copyright. You may not reproduce, modify, display, sell or distribute the Content, or use or exploit it in any other way (including without limitation in the creation of derivative works), for any public or commercial purpose (including without limitation reverse engineering, or copying or adapting the HTML codes used to generate Web pages on the SATS HK website). Linking the SATS HK website to any other website or mirroring any of the information on the SATS HK website on any other server is also expressly prohibited without our prior written consent.
   
   
   2. "SATS HK", the "SATS HK" mark and logo and certain other names, marks and logos used on the SATS HK website are names, trade marks, service marks and logos proprietary to SATS HK or which belong to other parties who have authorized SATS HK to use the same on the SATS HK website. Advertising content will be proprietary or licensed to the advertisers concerned. All these are similarly protected under paragraph 3a above.


4. ACCEPTANCE USE OF THE SATS HK WEBSITE
   
   
   1. As a condition of your use of the SATS HK website, you represent, warrant and agree that you will not use, or plan, encourage or help others to use, the SATS HK website for any purpose or in any manner that is prohibited by these Terms and Conditions or by applicable laws and regulations of Singapore, India or elsewhere (including without limitation the following Singapore laws or India laws: Telecommunications Act, Computer Misuse Act, Copyright Act and Electronic Transactions Act).
   
   
   2. You are prohibited from violating or attempting to violate the security of the SATS HK website, including without limitation:

      1. attempting to probe, scan or test the vulnerability of a system or network or to breach or circumvent security or authentication measures without proper authorization;

      2. attempting to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to the SATS HK website, overloading, "flooding", "spamming", "mailbombing" or "crashing";

      3. sending unsolicited e-mail, including without limitation promotions and/or advertisements of products or services; or

      4. forging any TCP/IP packet header or any part of the identifiers or header information in any e-mail or posting.

   3. Violations of system or network security or paragraphs 4b.i. to iv. above may result in civil or criminal liability. SATS HK will investigate occurrences which may involve such violations and may involve, and cooperate with (including disclosing information obtained about Users), law enforcement authorities in prosecuting Users who are involved in such violations.



5. DEACTIVATION OR SUSPENSION OF ACCESS

   SATS HK may at any time and from time to time deactivate or suspend (temporarily or permanently) the User's access to SATS HK website and/or the Services (as the case may be) without notice, to carry out system maintenance, upgrading, testing, repairs and other works or for any other reasons. Without prejudice to the other provisions of these Terms and Conditions, SATS HK shall not be liable for any loss, damage, costs or expenses that the User may suffer or incur resulting from such deactivation or suspension.

6. TERMINATION OF SERVICE

   SATS HK may at any time terminate temporarily or permanently the operation of the SATS HK website, for any reason, without notice. Without prejudice to the other provisions of these Terms and Conditions, SATS HK shall not be liable for any loss, damage, costs or expenses that the User may suffer or incur as a result of such termination.

7. DISCLAIMERS AND LIMITATIONS ON SATS HK' LIABILITY
   
   
   1. The provisions of this paragraph 7 apply and bind you, notwithstanding anything to the contrary contained elsewhere in these Terms and Conditions.
   
   
   2. SATS HK assumes no responsibility for the activities or conduct of Users or use or misuse of this SATS HK website by Users.
   
   
   3. Nothing on the SATS HK website shall be considered an endorsement, representation or warranty of or by SATS HK with respect to any third party or any third party's website (or its content), products, services or otherwise. The foregoing applies inter alia to any paid advertising content, as well as links that may be provided on the SATS HK website to third party websites. Such links are provided solely as a convenience to Users. Users shall use such links to access third party websites at their own risk. SATS HK makes no representations or guarantees regarding the availability or content (including its truthfulness, accuracy, completeness, timeliness or reliability) of such third party websites in respect of which links have been provided in the SATS HK website, nor with regard to broken links.
   
   
   4. SATS HK makes no representations or guarantees regarding the Content, or regarding the truthfulness, accuracy, completeness, timeliness or reliability of any information, contained in the SATS HK website or in any email or other form of communication with Users. Without prejudice to the generality of the foregoing, such information may have been obtained unverified by SATS HK from a variety of third party sources. You acknowledge that any reliance by you on the Content or on any such information will be at your own risk. SATS HK assumes no responsibility for the timeliness, deletion or misdelivery of, or failure to store, receive or respond to, any communications to or from Users, for any reason.
   
   
   5. SATS HK is based in India. SATS HK makes no claims that the Content is appropriate or may be downloaded outside of India. Access to the Content may not be legal by certain persons or in certain countries.
   
   
   6. Your dealings with advertisers on the Site are solely between you and such advertisers. We shall not be responsible for any loss, damage, costs or expenses that you may suffer or incur as a result of as a result of any such dealings or otherwise arising from the presence of such advertisers on the Site.
   
   
   7. SATS HK may change the SATS HK website and the Content at any time and in any manner it sees fit.
   
   
   8. SATS HK does not warrant that the Site will operate error-free or that the Site and its servers are free of computer viruses or other harmful mechanisms or effects or defamatory material. SATS HK does not warrant the security or protection of the Content from illegal or unlawful corruption by unauthorized parties or hackers. If your use of the Site or the Content results in the need for servicing or replacing equipment or data, SATS HK is not responsible for those costs. You assume all responsibility and risk for your use of the Site and the Internet generally. The Site and the Content are provided on an 'as is' basis without any warranties of any kind, express or implied. SATS HK, to the fullest extent permitted by law, disclaims all warranties, including without limitation the warranties of merchantability, title, non-infringement of your or any third parties' rights, or fitness for particular purpose, or regarding the accuracy, reliability, completeness or timeliness of the Services, Content, software or links of or provided on the Site.
   
   
   9. In no event shall SATS HK or its advertisers be liable for any damages, loss, costs or expenses whatsoever (including without limitation, incidental and consequential damages, lost profits, or damages resulting from lost or corrupted data or business interruption) resulting from the use of or access to, or the inability to use or access, the SATS HK website or the Services or the Content, whether based in contract, tort or other legal theory, and whether or not SATS HK is advised of the possibility of such damages.
   
   
   10. If the limitations set forth in this paragraph 7 above are held inapplicable or unenforceable as against you for any reason, then SATS HK's maximum liability to you for any type of damages shall be limited to USD100.00 in aggregate.
   
   
   
8. INDEMNITY

   You shall indemnify and hold harmless SATS HK, its directors, employees and agents, from and against any and all claims, proceedings, liability, loss, damage, costs and expenses whatsoever (including without limitation legal costs on a full indemnity basis), resulting or allegedly resulting from your use of or reliance on the Site or the Content, or your breach of any of these Terms and Conditions.
